These general terms and conditions of sale apply exclusively between the company EURL Nails and Co: 102 avenue des Champs Elysées 75008 PARIS (hereinafter "We") and any person visiting or making a purchase on the site. www.ulka.fr or in-store (hereinafter "you"). Anyone visiting the website or our stores can read the general terms and conditions of sale on the site. www.ulka.fr (hereinafter the "site" or upon request in store). These general terms and conditions of sale may be subject to modifications, and the applicable conditions are those in effect on the site at the time of placing your order or purchase.

Article 2: Products

The products governed by these general terms and conditions are those listed on the website, those provided in-store, and those indicated as sold and shipped by. ULKA FRANCE. Article 3: Contract

3.1 Conditions to place an order

When placing an order on the website ULKA.FR, you declare to be a professional in hairdressing or aesthetics, or to have been trained and considered as such. ULKA FRANCE disclaims all responsibility for the use of professional products sold on the website. You must be at least 18 years old and have the legal capacity necessary to place an order or have parental authorization.

3.2 Steps to conclude the contract

Once your order has been placed, an email summarizing the details will be sent to you. This email will confirm the registration of your order in our system. Your order implies your full acceptance of the present general terms and conditions of sale.

Article 4: Price, availability, and delivery

4.1 Price

The prices displayed on the website www.ulka.fr Prices are indicated in euros. For deliveries in mainland France, prices are indicated all taxes included (TTC), including the applicable VAT in France. For orders placed from overseas departments and territories (DOM-TOM), the European Union (excluding France), or internationally, prices are displayed excluding taxes (HT). In this case, the customer is responsible for paying the VAT and any customs duties upon the arrival of the order in their destination country, in accordance with local regulations. For professionals with a valid intra-community VAT number, French VAT is not charged for deliveries within the European Union, subject to the validity of the provided number. Shipping costs, order processing fees, and gift wrapping are not included in the product prices and are added during the order validation process.

4.2 Availability

Your order will be accepted subject to the availability of items in stock. Each product featured on the website is, unless otherwise stated, immediately available. In the event that a product becomes unavailable after your order has been validated, we will inform you as soon as possible.

4.3 Delivery

Deliveries are made to the address provided during your order. The maximum delivery time is 15 days. The delivery times indicated during the order are for guidance only and cannot be considered a firm commitment on our part. For deliveries outside mainland France, customs fees, local taxes, or import duties may be applied upon arrival of the package and are the sole responsibility of the customer.

4.4 Delivery Dispute

When receiving your order, it is imperative to check the condition of the packages in the presence of the delivery person. Any claim regarding observed damages must be clearly, precisely, and detailedly noted on the delivery slip. The mention "subject to unpacking" has no legal value and cannot be taken into account.

4.5 Mediation

In accordance with Articles L.612-1 and following of the French Consumer Code, any consumer has the right to make free use of a consumer mediation service with a view to the amicable resolution of a dispute with the professional.

Before referring the matter to the mediator, the consumer must first submit a written complaint to the company’s customer service. If this complaint is unsuccessful or if no response is received within 30 days, the consumer may refer the matter to the mediator whose contact details are as follows:

Article 5: Payment

5.1 On the website:

5.1.1 Payment by credit card (Payplug) and Paypal

You can pay for your order by credit card. Cards issued by banks located outside of France must be international credit cards. If you choose to pay by credit card, the amount of your order will be debited at the time of order validation.

5.1.2 Payment for your order in 2X, 3X, or 4X by credit card from 75€ of purchases up to 2000€ with Alma.

Payment in installments/deferred payment is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases:

  • P2X: Only purchases between €50 and €2,500 are eligible for payment with Alma.
  • P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
  • P4X: Only purchases between €50 and €2,500 are eligible for payment with Alma.

By paying in installments with Alma, the customer does not pay any fees. Except for the following cases:

  • 2X: 0.85% per transaction
  • P3X: 1.69% per transaction
  • P4X: 2.62% per transaction

Alma is a telepayment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code.

Termination: Any termination of the General Terms and Conditions (GTC) that bind the Seller and the customer, results in the termination of the General Terms of Use (GTU) between Alma and the customer.

5.2 In store:

The price of the products is payable in full on the day of purchase in-store by the Buyer, according to the following terms: in cash, within the limit provided by current regulations, or by credit card. The Buyer guarantees to EURL Nails and Co that they have the necessary funds to pay for the product. The Buyer also guarantees to EURL Nails and Co that they are fully authorized to use the payment method used for the payment of their purchase, and in particular that they have the necessary authorizations to use this payment method at the time of validating their purchase.

ARTICLE 6: Return Policy - Professional Customers

6.1 No right of withdrawal

Purchases made by professionals are not subject to the right of withdrawal provided for by the Consumer Code.

6.2 Return accepted for commercial reasons

For commercial purposes, ULKA FRANCE allows professionals to return certain products subject to compliance with the conditions below:

6.3 Return conditions

  • The professional customer must submit a return request via email, specifying the order number and the relevant references.
  • The items must be returned within 14 days following the return agreement, to the following address:

6.4 Return conditions

  • The products must be new, unused, unopened, and in their original intact packaging.
  • The product packaging box should not be used as a shipping package. The customer must use an external protective box. Any package with a label directly attached to the product packaging will be refused.

6.5 To have

After receiving and checking the returned items, a credit note will be issued and can be used on a future order.

ARTICLE 7: Receipt of a non-compliant or damaged product

7.1 Mandatory verification upon delivery

Upon receiving the order, the customer is required to check the condition of the package in the presence of the carrier or upon hand delivery.

In case of a damaged, torn, crushed, partially opened, repackaged, or with the original tape cut package, it is imperative to:

  • Refusing the package
  • Where to make specific and detailed reservations on the delivery slip or via the delivery driver's electronic terminal (e.g. "package torn on the left side", "packaging opened and resealed", etc.).

Without any reservations made at the time of delivery, no claims regarding damage found on the package will be accepted.

7.2 Mandatory notification within 3 days

In addition to reserves, any claim for damaged or non-compliant items must be addressed to ULKA FRANCE within three (3) business days following receipt of the package.

7.3 Supporting documents to be provided

The client must send the following elements by email:

  • A photo of the received package with the label visible
  • Photos of damaged or non-compliant products
  • A copy of the invoice is enclosed in the package.
  • If applicable, a photo of the delivery receipt with the reservations issued.

7.4 Analysis and response

Upon receipt of the items, ULKA FRANCE will proceed with the necessary verifications with the logistics team and the carrier. In case of confirmation of the error or damage, we will propose one of the following solutions:

  • Free return of a replacement product
  • Issuance of a credit note (for professional clients)
  • Full refund of the product in question

7.5 Return of non-compliant product

In case of a product error, the return of the product in question is mandatory. A prepaid label will be provided. The customer will need to:

  • Use appropriate protective packaging (the product box should not be used directly).
  • Please attach a copy of the invoice.
  • Send a proof of deposit upon shipment.

The replacement or refund process will take place upon receipt of the return.

7.6 Limitation of liability

ULKA FRANCE reserves the right to refuse any claim:

  • Performed beyond the legal deadline of 3 days
  • Without any reservations made during delivery.
  • Unaccompanied by the requested justifications
  • Regarding a product that matches the order.

Article 8: Management of parcels in case of absence or non-collection

8.1. Delivery in case of absence

In case the customer is not present for home delivery, the carrier may either leave the package at a pick-up point or attempt redelivery at a later date, according to their general terms of service. It is the customer's responsibility to collect their package within the time frame specified by the carrier.

8.2. Unclaimed package

If the customer does not pick up their package within the time frame specified by the carrier and it is returned to our warehouse, the following rules apply:

  • Refund: Only the amount of the products will be refunded. The initial delivery fees will not be refunded, as the transportation service was provided in accordance with the order.
  • New shipment: If the customer requests a new shipment, the corresponding shipping costs will be at their expense, even if the initial shipping costs had been waived.

8.3. Deduction of shipping costs in case of return not attributable to the company

For any order eligible for free shipping (for example, orders over 150 €), if the package is returned to ULKA FRANCE due to a reason attributable to the customer (failure to pick up within the specified time frame, incorrect address, refusal of delivery), the shipping costs incurred by ULKA FRANCE for the initial shipment will be deducted from the refund amount. The amount of shipping costs withheld will correspond to the actual cost incurred by ULKA FRANCE, even if the fees had been waived during the initial order.

8.4. Customer responsibility

It is the customer's responsibility to track the delivery provided by the carrier and ensure the package is retrieved within the specified timeframe.

8.5. Order abandonment

In the absence of a claim or express request from the customer regarding a refund or reshipment within 30 days after the return of the package to our warehouse, the order will be considered abandoned. No refund or reshipment will be made after this deadline.

Article 9: Retention of Title

Our company expressly reserves ownership of the goods delivered until full payment of the principal price, and any applicable interest. The goods will remain the property of the selling company until full payment of their price, but the buyer will become responsible for them from the moment of physical delivery, with the transfer of possession entailing risks. In the event of partial payment or complete non-payment, the recovery of the goods may take place in accordance with current legal provisions. This recovery may occur even in the case of judicial settlement or liquidation of the buyer's assets.

Article 10: Guarantees and Liability

10.1. Legal and commercial warranties

Professional customers, whether they act as end users (e.g. salons, institutes, self-employed individuals) or as resellers, do not benefit from the protective provisions of the Consumer Code regarding the legal guarantee of conformity.

However, ULKA FRANCE applies a maximum duration legal guarantee for professional purposes of one (1) year from the date of purchase and exclusively on electrical products.

10.2 Coverage conditions

As part of this professional guarantee, the following conditions apply:

  • The professional client takes charge the return costs of the defective product until after-sales service ULKA FRANCE.

10.4 Acceptance of the terms

By validating their order, the professional client acknowledges having read and accepted the applicable warranty conditions as described in these General Terms and Conditions of Sale.

10.5 Specificities for accessories (cables, chargers, batteries) and technical devices

Technical devices (such as nail dust vacuum cleaners or LED lamps) and their accessories (cables, batteries, chargers) are also covered by legal warranties. However, these warranties do not cover damages or malfunctions resulting from:

  • From improper use or use not in accordance with the recommendations: for example, exposure to extreme temperatures, prolonged or overloaded use of devices, or connection to a non-compatible adapter.
  • Due to a lack of maintenance: such as the accumulation of dust in a vacuum cleaner due to insufficient cleaning or the use of an LED lamp in an unsuitable environment (humidity, dust).
  • Physical damage: twists, cuts, or damage to cables and connectors caused by improper handling, or swollen batteries due to overcharging or misuse.

We reserve the right to conduct a technical inspection to assess if the reported defect is covered by the warranty. In case of non-compliance with the usage recommendations, the repair or replacement costs will be the responsibility of the customer.

10.6 Limitation of liability

We decline any responsibility for damages or malfunctions resulting from improper use or lack of maintenance of the product. We cannot be held responsible for:

  • Any non-substantial differences between the product presentation photos on our website and the delivered products.
  • Indirect damages (business losses, data loss, or loss of earnings) that were not foreseeable at the time of contract conclusion. In the event of receiving a damaged package, it is the customer's responsibility to make clear reservations with the carrier. Any claim related to a delivery issue (damaged, lost, or undelivered package) must be accompanied by a non-delivery certificate to be processed.

Promotional codes are limited to one code per customer, per order, and per email address.
